1. Definitions

  • LeadKong: refers to LeadKong SAS and its platform accessible at leadkong.com
  • User: any person using the LeadKong platform
  • Customer: user who has subscribed to a paid plan
  • Services: all features offered by LeadKong (AI chatbot creation, conversation management, etc.)
  • Chatbot: conversational assistant created via the LeadKong platform

2. Acceptance of Terms

Using LeadKong implies full acceptance of these Terms. If you do not accept these conditions, please do not use our services.

3. Description of Services

LeadKong provides a platform that allows you to:

  • Create and configure AI chatbots for your website
  • Customize AI responses and behavior
  • View and manage conversations with your visitors
  • Automatically qualify leads
  • Integrate chatbots via widget or API

4. Registration and Account

4.1 Account Creation

To use LeadKong, you must create an account by providing accurate and up-to-date information. You are responsible for maintaining the confidentiality of your credentials.

4.2 Account Security

You agree to:

  • Use a secure password
  • Not share your credentials
  • Notify us immediately in case of unauthorized use

5. Use of Services

5.1 Authorized Use

You agree to use LeadKong legally and in accordance with these Terms. You may create chatbots for your professional or personal activities.

5.2 Prohibited Uses

It is strictly forbidden to:

  • Use LeadKong for illegal activities
  • Create chatbots spreading hateful, discriminatory or illegal content
  • Collect personal data without consent
  • Attempt to circumvent security measures
  • Intentionally overload our servers
  • Resell or sublicense access to the platform
  • Use bots or automated scripts to access the service

6. Intellectual Property

6.1 LeadKong Rights

LeadKong retains all intellectual property rights to the platform, its code, design, algorithms and documentation.

6.2 Your Content

You retain ownership of your content (chatbot texts, FAQ, etc.). You grant us a limited license to host and display this content as part of the service.

7. Data and Privacy

The processing of your personal data is governed by our Privacy Policy.

8. Pricing and Payment

8.1 Subscriptions

LeadKong offers various subscription plans. Prices are shown on our Pricing page and may be changed with 30 days notice.

8.2 Billing

  • Subscriptions are billed monthly or annually
  • Payment is automatically charged at each due date
  • Invoices are available in your customer area

8.3 Refunds

Digital services that have been fully provided are generally not eligible for refund. Please contact us for specific situations.

9. Service Availability

9.1 Commitment

LeadKong strives to ensure maximum availability of its services. We aim for 99.9% uptime.

9.2 Maintenance

Interruptions may occur for maintenance. We will inform you whenever possible of scheduled maintenance.

10. Limitation of Liability

10.1 Warranties

LeadKong is provided "as is". We do not guarantee that the service will be error-free or uninterrupted.

10.2 Limitation

To the extent permitted by law, LeadKong's liability is limited to the amounts paid by the Customer during the last 12 months.

LeadKong shall not be liable for:

  • Indirect damages (loss of revenue, data, etc.)
  • Content created by users
  • Malfunctions related to third parties (host, browser, etc.)

11. Termination

11.1 By the User

You can cancel your subscription at any time from your customer area. Termination takes effect at the end of the current period.

11.2 By LeadKong

We may suspend or terminate your account in case of:

  • Violation of these Terms
  • Non-payment
  • Fraudulent use

12. Changes to Terms

We may modify these Terms. In case of substantial changes, we will notify you 30 days before they take effect. Your continued use of the service constitutes acceptance.

13. Applicable Law

These Terms are governed by French law. In the event of a dispute, the Paris courts shall have sole jurisdiction.
